Terms of Service

Vortex Heights Marketing offers digital marketing services, including, but not limited to:

• SEO (Search Engine Optimization)

• Paid Advertising and Campaign Management

• Automations and AI Agents

• Web Design

• Email Marketing

All services are subject to a separate contract specifying scope, deliverables, and fees.

• Clients must complete an intake form and participate in a free consultation.

• You must provide all required assets, including but not limited to business name, logo, access to relevant platforms (websites, ad accounts, email systems, Go High Level, etc.), and any other information requested by VHM.

• Failure to provide assets, access, or timely feedback will result in project delays, additional fees, or suspension of services at VHM’s discretion.

• All recurring services (SEO, ads, automations, email marketing) are billed monthly.

• Invoices are due upon receipt. If payment is not received within 60 days, VHM will send a written warning. If payment is not received within 75 days, all services will be suspended or terminated, including but not limited to:

  • Website and automation access revoked

  • SEO maintenance halted

  • Ads and email marketing discontinued.

•  Non-Refundable Services
  All payments made to Vortex Heights Marketing are non-refundable once work has commenced. This includes, but is not limited to, research, strategy, planning, design, implementation, and campaign management. Our services require the investment of time, expertise, and resources, which cannot be recovered once allocated.
• Project Cancellation Before Work Begins
  If a project is cancelled before any work has started, a refund may be issued at our sole discretion, minus any administrative or transaction fees incurred. Once work has begun, no refunds will be provided under any circumstances.
• Client Delays or Change of Mind
  Refunds will not be granted due to client delays, lack of participation, or a change of mind after the agreement is signed and work has commenced. Clients are responsible for providing all necessary information, access, and feedback in a timely manner.
• Service Delivery Guarantee
  If Vortex Heights Marketing fails to deliver the specific services outlined in the signed agreement, a partial refund may be considered solely for the portion of services not delivered. Dissatisfaction with results, subjective opinions, or unmet expectations outside the agreed scope do not qualify for refunds.
• Resolution Process
  If you are dissatisfied with any aspect of our service, you must notify us in writing within seven (7) days of delivery. We will make reasonable efforts to resolve the issue by providing additional support or service credits at our discretion. Refunds are a last resort and will only be considered if we are unable to deliver the agreed-upon services.
• Amendments
  Vortex Heights Marketing reserves the right to amend this Refund Policy at any time. Any changes will be communicated in writing and will apply to all new and ongoing projects.

• Ads: Client owns all ad content created specifically for their campaigns.

• Websites & Automations: VHM retains ownership. Client is granted a non-transferable, revocable license to use the website and automations for the duration of the contract and as long as payments are current. If payments lapse, access will be revoked and all related data may be deleted.

• VHM reserves the right to showcase any work (excluding confidential or proprietary information) in its portfolio, marketing materials, and case studies.

• Vortex Heights Marketing will use third-party platforms (including Meta, Google, Any CRM platforms, and automation platforms) to provide services

• Vortex Heights Marketing is not responsible for outages, data loss, or issues caused by third-party providers.

• Vortex Heights Marketing does not guarantee specific results, rankings, or lead volumes. Marketing outcomes depend on numerous factors outside our control (including market conditions, competition, and client cooperation).

• Any statements regarding expected results are estimates, not guarantees.

• To the maximum extent permitted by law, Vortex Heights Marketing’s total liability for any claim arising out of or relating to these services is limited to the amount paid by the client in the three (3) months preceding the claim.

• Vortex Heights Marketing is not liable for indirect, incidental, special, or consequential damages, including lost profits or business interruption.

• Either party may terminate the agreement with 30 days’ written notice.

• If the client breaches these terms (including non-payment), VHM may suspend or terminate services immediately.

• Upon termination, all outstanding fees become immediately due. Access to websites, automations, and ongoing services will be revoked.

• This Agreement is governed by the laws of the Province of Ontario, Canada.

• Any disputes will be resolved through binding arbitration in Ontario, Canada, unless both parties agree otherwise in writing.

• Vortex Heights Marketing will take reasonable measures to protect client data and confidentiality.

• By using our services, you consent to the collection and use of information as described in our Privacy Policy.
